Terms and Conditions for Applicant

* The applicant is required to read thoroughly and understand the terms and conditions, policies, procedures, code of ethics and business opportunities / programme of the company as given below and from the website named “www.acmegoldconcept.com”. This application / agreement form is considered as an authentic and legally binding document. This contract is between the
applicant (herein after referred to as Independent Business Associate (IBA) and ACME GOLD CONCEPT / ACME GOLD COMPANY PVT. LTD. (hereinafter referred to as Company).
  1. The applicant should have completed minimum 18 years of age. and shall be competent to enter into the contract.
  2. The applicant confirm that applicant entered into this agreement as an Independent Business Associate (IBA). Applicant status shall remain as that of an Independent / freelance business person and not an employee or company representative of Acme Gold Concept / Acme Gold Company Pvt. Ltd. Nothing in this agreement shall establish an employment relationship or other labor relationship between IBA and the company and nothing shall establish the IBA position as procurer, broker, commercial agent or other representative, known by whatever name. Vendor, acting in his / her own name, at his / her own responsibility and own account.
  3. The Acme Gold Concept business opportunity / programme comprises the sale of the products / starter product package and the service as per Acme Gold Concept product brochure.
  4. While applicant placing orders for any of the products /starter products package available with the company, he / she will have to pay the cost of the product / starter products package by way of crossed demand drafts favouring ‘ACME GOLD CONCEPT / ACME GOLD COMPANY PVT. LTD.’ payable at Mumbai.
  5. Part Payment / Full Payment / Booking Amount paid by applicant towards purchase of the product/starter product package will not be refunded under any circumstances, instead applicant shall pay the balance amount and collect product / starter product package.
  6. For all purpose, only the English version of any Acme Gold Concept materials / documents shall be deemed the official copy.
  7. Under no circumstances shall any person or applicant repackage or alter the packaging or labeling of the products in any way.
  8. IBA position will be terminated / suspended from the company if he / she:
    1. In case they about any other marketing plan at company’s depot or outside it.
    2. If they behave in an illegal manner with staff members or Associate / IBA of company at any of its depo.
    3. If they enter into financial transactions with any Associate / IBA in respect of company matter without brining to the knowledge of company.
    4. If they furnish any false or baseless information about the company. In such matters company’s decision would be binding on them.
  9. All material appearing on our websites are copyright. Permission to reprint or electronically reproduce any document or graphics is strictly prohibited unless Prior written consent is obtained from the company.
  10. If the applicant is a Partnership firm/ Private limited company, then the applicant has to provide all necessary documents.
  11. The company under no circumstances will accept any payment in cash.
  12. The company has not authorised any person, official, officer or (IBA) of the company to receive any kind of amount in cash on behalf of the company towards the cost of products / starter products package as the case may be.
  13. If any body or applicant makes any payment in cash, it will be at his / her own risk and under no circumstances, will the company be answerable to such unauthorised cash payments.
  14. The Independent Business Associate (IBA) will be eligible for incentives / compensation or income, rewards, royalty & bonus, promotion only as per the volume of business done by him that is also subject to the eligibility norms formulated by the company. The company does not assure any incentives / compensation or income, rewards, royalty & bonus to the IBA.
  15. The Independent Business Associate (IBA) will not be a consumer, agent, or employee of the company. His / her position being so, he / she cannot bind the company, in any manner nor he / has any authority to bind the company or to represent or speak on behalf of the company.
  16. The company will, in no case, entertain any communication without Track ID and password. The track ID cannot be altered / changed at any point of time. The company shall not be liable if IBA’S are unable to access company’s website due to any technical reason whatsoever including non-functioning of the website.
  17. If applicant pay cost of the products / material cost / service charges / facilities charges / IBA training fee / online registration fee not refundable and not transferrable and applicant has no right on that payment.
  18. The Independent Business Associate (IBA) has to pay annual renewal fees / facility charges / service charges/online registration fee at the end of 12 months as per the company norms.
  19. Upon the death of the IBA the right and responsibilities of the IBA are passed on to the rightful nominee as per the Law. The nominee shall be bound by the terms and conditions of the original IBA agreement and abide by the company’s
    rules and regulations.
  20. Service Charges, facility charges will be deducted as per Company norms. TDS will be deducted as formulated by the Government.
  21. The company reserves all rights to terminate a Independent Business Associate (IBA) agreement any time without having to enter into legal proceedings to require such termination.
  22. Once a Independent Business Associate (IBA) agreement is terminated, he/she cannot enter any of the ‘ACME GOLD CONCEPT / ACME GOLD COMPANY PVT. LTD.’ Premises / meeting / business locations and his / her incentives /
    compensation or income, rewards, royalty & bonus will be stopped immediately.
  23. The Independent Business Associate (IBA) shall bear true faith and allegiance to the company and shall uphold the integrity and decorum of the company and shall maintain good relations with other IBA’S and other clients.
  24. The Independent Business Associate (IBA) shall always behave and act in a dignified manner befitting the status of a IBA of a reputed company.
  25. The Independent Business Associate (IBA) shall not compel or induce or mislead any person with any false statement/ promise to purchase any product/product packages / starter products package.
  26. The company will not be answerable for any promise, assurance given by any Independent Business Associate (IBA) to any person, unless it is in accordance with the approved marketing / business plans and terms of the company. Hence,
    the applicant shall go through the website -“www.acmegoldconcept.com” and the brochures and notices issued by the company. Through these company sources, he/she will fully inform himself / herself on all these matters.
  27. The applicant / IBA shall ensure that all the information / furnished to the company is correct and properly entered. Any request for correction furnished by the Independent Business Associate (IBA) as to his / her sponsor or placement details
    will not be entertained.
  28. The company reserves the right to reject any Independent Business Associate (IBA) application at its own discretion.without having to enter into legal proceedings to require such termination.
  29. The company reserves the right to modify the terms and conditions, product / product packages / starter products package, plan, business / marketing plan and policies, giving prior notice through its website -“www.acmegoldconcept.com” and it will be binding on all IBA of the company.
  30. The terms and condition within above mentioned shall be governed in accordance with the Law in force in the territories of India. Disputes, if any arise, shall be subject to the exclusive of the Court of Mumbai.
  31. If any dispute or difference arises between the parties hereto touching the business or interpretation of any terms and conditions or as to incentives / compensation or income, rewards, royalty & bonus, promotion, income etc., relating to the business of the company, the same shall be referred to arbitration and the arbitration shall be governed by the ‘Arbitration And Conciliation Act, 1996’.

    Declaration / Affirmation from Applicant

  1. As an Independent Business Associate (IBA) I will bear true faith and allegiance to the company and shall uphold the integrity and decorum of the company.
  2. I will bear utmost honesty and uprightness to the IBA and the prospective IBA and to other clients of the company. I also swear that I will not indulge in any kind of unfair means to promote my business as a IBA.
  3. I have fully understood & am convinced of the terms and conditions with the norms
    of the company.
  4. I am fully aware that the payment made by me is towards cost of the products / material cost / service charges /facilities charges/ IBA training fee/online registration fee and hence not refundable and not transferrable and I have no right on that payment.
  5. I am made to understand that being a freelance Independent Business Associate (IBA), I will not be an agent, employee, or consumer of the company. Hence I have no authority to bind the company or to speak on its behalf.
  6. I declare that I have not been given any kind of assurance or promise by the company or its senior level Independent Business Associate (IBA) as to any income on account of the initial payment made by me. However I am made to understand that I will be eligible for incentives / compensation or income, rewards, royalty & bonus depending upon the volume of business done by me as per terms.
  7. I am fully satisfied and I have full faith and also understand the value of the Starter Products Packages / Products offered by the Company. I am aware that the amount paid by me is solely towards Purchase of the Starter Product Package / Products and it is neither refundable nor transferrable. If I fail to make the balance payment I am not liable to claim the Starter Product Package.
  8. I will not promote the business of other companies in the office, premises, and meeting / business hall or wherever the activities of the company takes place.
  9. I hereby agree and adhere to the terms and conditions stipulate along with the application form and as mentioned above and agree to do my own independent business and I will not misguide or induce any one dishonestly.
  10. I hereby agree to submit all disputes to arbitration as provided in the terms and conditions of the company.
  11. I declare that I am not doing any harmful deed against the company and not harassing the company/staff, associate and IBA of company. I accept that in case of breaching any terms and conditions of this agreement, company is entitled to immediately and unilaterally terminate my IBA appointment / agreement without having to enter into legal proceedings to require such termination.
  12. I accept the right of Acme Gold Concept to reject this Application or my appointment as a IBA at its absolute discretion and without being required to give any reason there of.
  13. After getting promotion you will be elegible only for the team bonus under your down line business.
  14. On each sale under your team you can get team bonus if the growth of 100% for twelve cycles.
  15. All figures are hypothetical figures based on assumption of 100% growth for 12 cycles and the company does not give any guarantee for growth it depends on individual is 30 days and maximum when next cycle target gets completed.
  16. Minimum period for completion of each cycles on completion of expected sales target is 30 days and maximum when next cycle target gets completed.
  17. A gap of 30 days for 1st closing payout.
  18. The company shall not be responsible for delays and failure in performance here under, where performance is made commercially impractical due to normal circumstances beyond and failure of either parties usual source of supply, government decrees or order.
  19. The associate will get the incentives in accordance with the growth of the team sales performance i.e. Higher the sales performance, Higher the growth,Higher the incentive.
